From what I understand, the commentaries are considered promotional
material of the same level as EPKs -- ie: that the studios have no
contractual obligation to pay for. But as with any promotional
material, the studios still do have to get the approval of the actors
to release the commentary tracks m on the DVDs, as actors get approval
of the use of their images in EPKs, on posters, merchandising and the
like so do they also get approval to use their voices. So it's more
of a situation of the actors rightfully holding the commentary tracks
hostage for better pay for the DVDs themselves than it is any attempt
to get paid for the commentary tracks. After all, profit
participation in the DVDs are *much* bigger fishes to follow than the
guppies of commentary tracks.
