Confessing Before Being Given Rights

by Amicus@[EMAIL PROTECTED] (David / Amicus) Aug 29, 2008 at 08:18 PM

I was watching an old rerun today. Lennie was arresting some punk and
said the kid confessed to him while he was putting on the cuffs.
Problem was he was the only one who heard it and of course the perp
denied saying it.

Not in so many words but Lennie's colleagues (Van Buren, Green etc.)
seemed to think he was making it up.

At the end of the ep the kid told McCoy that he had confessed to Lennie.

But when the kid was being arrested he wasn't at that moment actually
told his rights.

So it couldn't be used anyway could it? Like a perp can blab all he
wants before he gets his Miranda but then can shut up afterwards and it
not be entered into evidence?
