No, it depends on the local laws and on the specific situation.

After 9-11, the passengers on the jetliners that slammed into the Twin 
Towers were all declared legally dead fairly quickly.  It's not like 
there was even the slightest chance that any of the passengers could 
have survived that impact.

The case you're thinking of, is when a person just disappears without a 
trace.  But in the case of Flight 815, Naomi said they found the 
wreckage of the plane off Bali.  Under those cir***stances, they would 
assume everyone had died, just like in the 9-11 crashes.
