IANAL, but someone (usually a beneficiary) can ask a court to declare
someone dead if the have been missing for a long time with no evidence
that they're still alive (like Lord Lucan), or in this case, within
weeks or even days if they have been involved in an incident where the
chance of finding any more survivors is negligible (such as the World
Trade Centre). Don't forget, the rest of the world thinks the 'plane
came down in the ocean.
