Illegal does not necessarily equate to criminal.

Lawsuits are expensive, and take years. There are lots of civil 
violations that are never pursued by the victim.

Because the victims haven't bothered. Should they be forced to? Are you 
willing to pay the $100,000+ in legal fees that it will cost?

The government has no standing in a civil case between private 
individuals or companies. Nor should they. What you propose would clearly 
be unconstitutional censor****p.

Because the victims are the only ones with legal standing to do something 
about it - sue them - and have chosen not to (so far as I know).

I've already explained it. The most likely issue to show up in court 
would be the military personnel suing for defamation for the deliberate 
misrepresentations Moore perpetrated of their views. I know at least one 
of his victims has publicly discussed the possibility of suing his fat 
ass for his lies. Perhaps they did, and Moore et al settled quietly. 
Certainly, they wouldn't want to put that in front of a jury, given the 
potential his lies had to damage careers.
